EU Digital Services Act, Articles 16 to 17 and 20: notice-and-action mechanism, statement of reasons, internal complaint handling.

• The Digital Services Act has applied to all intermediary services with users in the EU since February 17, 2024, including small hosting services and marketplaces outside the EU.
• Article 16 requires an easy-to-access electronic notice mechanism for allegedly illegal content, an acknowledgment of receipt, and a timely, diligent, non-arbitrary decision; Article 17 requires a statement of reasons to the affected user; Article 20 requires an internal complaint-handling system for at least six months after a decision.
• Notices must allow the reporter to explain why the content is illegal, give its exact location, their name and email (except for certain offences) and a good-faith statement.
