Your product photos and the text of your listing are copyrighted from the moment you create them, so a seller who lifts them is infringing even if their physical item differs. Etsy's Intellectual Property Policy says listing reports go through the Etsy Reporting Portal, which reaches Etsy's designated agent under the DMCA; the separate infringement form covers only usernames, shop names and videos. Give the URLs of the copied listings, links to your originals, your contact details, and the good-faith and penalty-of-perjury statements required by 17 U.S.C. § 512(c)(3). Etsy says it removes or disables material when a report that complies with its policy arrives, notifies the seller, and may hand them a copy of your report including your name and email address. The seller can file a counter notice; Etsy may restore the listing 10 business days after processing it unless you tell Etsy you have filed a court action or a claim with the Copyright Claims Board. Etsy terminates the selling privileges of repeat infringers in appropriate circumstances, and only accepts withdrawals from the person who filed. Copies that appear on Amazon, eBay or a standalone store need separate notices to those hosts.
