Can I use the Take It Down Act for an AI deepfake of me?

Yes. The TAKE IT DOWN Act expressly covers "digital forgeries": intimate visual depictions created or altered with AI or other software so that a reasonable person would view them as indistinguishable from an authentic image of you. The Section 3 notice-and-removal process treats a sexually explicit deepfake exactly like a real intimate image. If you can be identified in it and did not consent to its publication, you can send a covered platform a valid request and it must remove the deepfake and known identical copies within 48 hours. Publishing a deepfake of an adult without consent to cause harm, or of a minor, is also a federal crime under Section 2, so it can be reported to the FBI at ic3.gov or local police; the Justice Department seized two deepfake-nude sites under the Act in 2026.
