For ordinary, non-sexual photos, no federal law stops someone from posting a picture of your child, so removal depends on platform rules: Meta and TikTok publish privacy-violation report forms, and Meta's accepts reports from a parent or guardian about a child under 13. Everything changes if the image is nude, partially nude or sexual. The TAKE IT DOWN Act's notice-and-removal rule (in force since May 19, 2026) covers any identifiable individual, including a minor (under 18), and lets an authorized person such as a parent send the platform a signed request with the URL, a good-faith statement that it was published without consent, and contact details; the platform must remove it and identical copies within 48 hours or face FTC enforcement. Also report to NCMEC's CyberTipline (report.cybertip.org) and use NCMEC's free Take It Down hashing service (takeitdown.ncmec.org), which lets participating platforms detect and remove the image unseen.
