Do-not-call and email opt-out policy ([Site name]) Effective [date]. Available on request under 47 CFR 64.1200(d)(1). 1. Purpose. [Site name] ([https://example.com]) makes or arranges telephone calls, text messages and email for marketing purposes. This policy sets out how we honor a person's request not to be contacted, as the Telephone Consumer Protection Act rules (47 CFR 64.1200) and the CAN-SPAM Act require. 2. How to opt out. Tell us by any of these routes: our opt-out form, email [contact email], phone [phone number for opt-out requests], reply STOP to any text message, or the unsubscribe link in any email. We do not require you to log in, pay a fee, or give more than the number or address to be removed. 3. Company-specific do-not-call requests (calls and texts). We record the request with the date received, the number and the name given, and honor it within a reasonable time not exceeding 10 business days (47 CFR 64.1200(d)(3)). The request covers [Site name] and any affiliate a consumer would reasonably expect to be included (64.1200(d)(5)). The record is kept, and the request honored, for five years from the date it is made (64.1200(d)(6)). 4. Email opt-outs. Every commercial email we send includes a working unsubscribe mechanism that stays active for at least 30 days after sending. We process opt-outs within 10 business days, and we do not sell or transfer the addresses of people who have opted out except to a vendor helping us comply. 5. Identification. Callers state their name, that they call for [Site name], and a number or address at which we can be reached (64.1200(d)(4)). Our emails carry an accurate "From" line, a non-deceptive subject line, and our postal address: [postal address]. 6. National Do Not Call Registry. Before any telemarketing call we screen our lists against the National Do Not Call Registry using a version obtained no more than 31 days earlier (64.1200(c)(2)), and we keep the records that show it. 7. Training and responsibility. Everyone who makes calls or sends messages for us is trained on this policy before they start (64.1200(d)(2)). Questions and requests: [contact email].
What a Do-Not-Call and Unsubscribe Policy must contain
- A written policy available on demand and training for everyone who calls or texts on your behalf (47 CFR 64.1200(d)(1) and (2)).
- Record each company-specific do-not-call request and honor it within a reasonable time not exceeding 10 business days (64.1200(d)(3)); keep the record and honor the request for five years (64.1200(d)(6)).
- Identify the caller, the entity on whose behalf the call is made and a contact number or address (64.1200(d)(4)); apply the request to affiliates a consumer would reasonably expect to be covered (64.1200(d)(5)).
- Screen against the National Do Not Call Registry with a version no more than 31 days old (64.1200(c)(2)).
- CAN-SPAM: a working opt-out in every commercial email that stays active for at least 30 days, honored within 10 business days, with no fee or extra steps and no transfer of opted-out addresses; accurate headers, an honest subject line and a physical postal address.
