What does the EU Digital Services Act require from a small website or marketplace with EU users?
Since February 17, 2024 every hosting service with users in the EU, including small forums, marketplaces and hosts based elsewhere, must provide an easy, electronic way for anyone to notify it of allegedly illegal content (Article 16), acknowledge receipt, decide diligently and without undue delay, and tell the reporter the decision.
When you remove or restrict content you must give the affected user a statement of reasons (Article 17) and let them contest it through an internal complaint system for at least six months (Article 20). Very small enterprises are exempt from some later obligations but not from Articles 16 and 17.
A hosted notice desk that records the notice, the acknowledgment, the decision and the statement of reasons is the simplest way to show compliance.
