Medicare itself does not cold-call people. Medicare.gov states that Medicare will never call you to sell you anything or visit your home, and only asks for personal information in limited situations. Calls pitching "new Medicare benefits," free braces or a plan switch are scams or unlawful marketing. Under CMS rules (42 CFR § 422.2264(a)(2)), Medicare Advantage plans and their agents may not make unsolicited calls, robocalls, texts or voicemails unless you asked to be contacted. Prerecorded or autodialed calls to a cell phone also need your prior express consent under the TCPA (47 U.S.C. § 227), and a company you have dealt with must honor a do-not-call request within 10 business days (47 CFR § 64.1200(d)(3)). Never give your Medicare number to a caller. Hang up, block the number, and report it at donotcall.gov/report.html, reportfraud.ftc.gov or 1-800-MEDICARE; the Senior Medicare Patrol (877-808-2468) also takes reports.
