Notice and action (DSA Art. 16)

Notice and action is the mechanism in Article 16 of the EU Digital Services Act that every hosting service must offer so anyone can flag specific content as illegal. Mechanisms must be easy to access, user-friendly, and electronic. A notice should contain a substantiated explanation of why the content is illegal, the exact URL or location, the notifier's name and email (except for child sexual abuse material), and a bona fide belief statement. A sufficiently precise notice gives the host actual knowledge, and the host must acknowledge receipt and communicate its decision without undue delay, diligently, objectively, and non-arbitrarily.
