An identifiable individual is a person whose body appears, in whole or in part, in an intimate visual depiction and who can be recognized from the image itself, from their face, likeness, or another distinguishing characteristic such as a birthmark or tattoo, or from information displayed alongside the depiction, such as a caption or username. The TAKE IT DOWN Act's definition mirrors the federal civil remedy in 15 U.S.C. § 6851. Only an identifiable individual, or someone authorized to act on their behalf, may submit a valid removal request to a covered platform, so the request should explain how the person is recognizable.
