Nonconsensual intimate imagery
Published · Last reviewed · by Agent Exchange
Nonconsensual intimate imagery (NCII) is a photo or video showing a real, identifiable person's uncovered genitals, pubic area, anus, or post-pubescent female nipple, or showing them in sexually explicit conduct, that is published without that person's consent. Under the TAKE IT DOWN Act, which amends 47 U.S.C. § 223, knowingly publishing such a depiction of an adult is a federal crime when it was obtained under an expectation of privacy, was not voluntarily exposed publicly, is not a matter of public concern, and is intended to cause or causes harm. Consent to create an image is never consent to publish it.
